1. Company Information and Service Overview

These Terms of Service ("Terms") govern your access to and use of the CarFlipper.ai service ("Service").

Service Description: CarFlipper.ai provides automated car deal discovery services through a Telegram bot platform. Our Service crawls publicly available car listings from websites around the world, including Facebook Marketplace and automotive aggregators, and delivers curated deal notifications to users via Telegram and Web App.

AI Processing Disclosure: Our Service uses artificial intelligence systems, including Claude AI and ChatGPT, to analyze, filter, and enhance car deal information through automated content triaging and context expansion. Users are hereby notified that they are interacting with AI-powered systems that process and recommend automotive deals based on algorithmic analysis.

2. Acceptance and Modification of Terms

  • By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Company under Brazilian law.
  • We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of the Service after changes constitutes acceptance of modified Terms.
  • Your electronic acceptance of these Terms creates a valid and enforceable contract under Brazilian Electronic Document Law (Law 14.063/2020) and applicable international digital commerce regulations.

3. User Eligibility and Account Registration

  • Our Service is available to all Telegram users worldwide. There are no specific age restrictions, but users must comply with Telegram's Terms of Service and local laws governing their use of communication platforms and automated services.
  • To access premium features, users must create an account through our Telegram bot interface and provide accurate registration information including valid email addresses and preferred notification settings.
  • We reserve the right to refuse service to users who violate these Terms, engage in fraudulent activities, or use the Service for illegal purposes under applicable laws.

4. Service Features and Limitations

Core Features:

  • Automated crawling and aggregation of publicly available car listings from websites around the world
  • AI-powered deal analysis and filtering based on user preferences
  • Real-time notifications via Telegram, Push notifications and Web App
  • Credit-based and subscription access models
  • Advanced search and filtering capabilities

Service Limitations:

  • Information is aggregated from third-party sources and provided "as is" without warranties of accuracy, completeness, or timeliness
  • We aim for high uptime but do not guarantee uninterrupted service
  • Service focuses on automotive markets around the world
  • Deal information may become outdated as external listings change or expire
  • Service relies on third-party platforms including Telegram, cloud hosting, and automotive listing websites. Interruptions may occur due to factors beyond our control.

5. Subscription and Token System

  • We offer services through both Credit-based purchases and subscription plans. Users can purchase tokens for individual use or subscribe to plans for ongoing access.
  • All payments are processed securely through our payment processing platform. By making purchases, you acknowledge that your payment information will be processed according to industry security standards and our Privacy Policy.
  • Brazilian Consumer Rights: Brazilian residents have the right to cancel any online purchase within 7 days of completion and receive full refunds. This right cannot be waived and applies to all token purchases and subscription services.
  • Subscription Billing: Subscriptions automatically renew at the end of each billing period. We will provide 30 days' notice for subscription price increases. Users may cancel subscriptions at any time through account settings or by contacting support. Unused portions of subscription periods will be refunded according to applicable consumer protection laws.
  • Token System: Tokens are sold individually or in packages for specific service features. Tokens are consumed based on service usage and feature access. Brazilian users retain the right to refund unused tokens within legal withdrawal periods.

Affiliate Disclosure

  • Our Services may include links to products and services offered by third parties, including eBay and other affiliates.
  • These links may be affiliate links, meaning we can earn a commission if you click a link and make a purchase. This commission helps us maintain and improve our Services.
  • We are committed to transparency—affiliate relationships do not influence our content, topics, or product recommendations. We only recommend products or services that we believe provide value to our users.

Children’s Data

  • Our Services are not intended for use by children, and we do not knowingly collect personal information from children.
  • If you are the parent or guardian of a child who has provided us with personal information, please contact us at support@carflipper.ai to request deletion of that information.

International Users

  • Your personal information may be transferred to, stored in, and processed in countries outside of your residence, including the United States.
  • Your information is also processed by our staff, third-party service providers, and partners in these countries, subject to appropriate legal protections and safeguards.

6. Intellectual Property Rights

  • The Service, including software, algorithms, trademarks, and content (excluding user data and public automotive listings), is owned by Company and protected under Brazilian and international intellectual property laws.
  • We grant users a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes during the term of their subscription or token validity.
  • We aggregate publicly available information from automotive websites. We respect intellectual property rights and do not claim ownership of third-party automotive listings or images.
  • Users retain ownership of any data they provide to the Service. By using the Service, users grant us necessary licenses to process their information for service delivery.

7. Prohibited Uses and User Conduct

  • Using the Service for illegal purposes under applicable laws
  • Attempting to reverse engineer, hack, or compromise Service security
  • Sharing account credentials or attempting to resell access
  • Using automated systems to access the Service beyond normal use
  • Violating third-party websites' terms of service through our platform
  • Engaging in activities that could harm other users or the Service
  • Users must respect intellectual property rights of automotive listing sources and not use aggregated data for competing commercial services.
  • Users must comply with applicable laws in their jurisdiction regarding automated data services, consumer transactions, and digital communications.

8. Third-Party Services and Integrations

  • Our Service operates through Telegram's bot platform and a dedicated Web App. Users must comply with Telegram's Terms of Service. The Telegram bot availability depends on Telegram's platform stability and policies.
  • Payments are processed through our secure payment platform within the CarFlipper app. Payment disputes should be directed through the channels outlined in our customer support procedures.
  • We collect information from public automotive websites. Changes to these sources may affect Service functionality. We do not guarantee continuous access to any specific data source.

9. Privacy and Data Protection

  • Our comprehensive data processing practices are detailed in our Privacy Policy, which forms an integral part of these Terms. We comply with Brazilian LGPD, applicable US state privacy laws, Canadian PIPEDA, and international data protection requirements.
  • User inquiries and automotive data are processed through AI systems (Claude AI and ChatGPT) for content analysis and recommendation generation. Users have the right to understand how AI systems impact their service experience and may request human review of AI-driven decisions.
  • User data may be transferred internationally for service operation, subject to appropriate safeguards including Standard Contractual Clauses approved by Brazilian data protection authorities.

10. Service Availability and Interruptions

  • We strive to maintain high service availability but do not guarantee uninterrupted access. Service may be temporarily unavailable due to maintenance, updates, or unforeseen technical issues.
  • We are not liable for service interruptions caused by circumstances beyond reasonable control, including but not limited to natural disasters, cyberattacks, telecommunications failures, government actions, pandemics, or third-party service provider outages.
  • Scheduled maintenance will be announced in advance when possible. Emergency maintenance may occur without prior notice to protect system security and stability.

11. Limitation of Liability and Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of accuracy, reliability, or fitness for particular purposes.
  • Automotive listing information is aggregated from third-party sources and may be incomplete, outdated, or inaccurate. Users must independently verify all information before making purchasing decisions. We are not responsible for decisions made based on Service data.
  • To the maximum extent permitted by applicable law, Company's total liability for all claims related to the Service shall not exceed the amounts paid by the user in the 12 months preceding the claim. This limitation applies regardless of the legal theory upon which the claim is based.
  • We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, business interruption, or loss of business opportunities.
  • Nothing in these Terms limits liability that cannot be limited under Brazilian consumer protection law, including liability for gross negligence or willful misconduct.

12. Indemnification

Users agree to indemnify, defend, and hold harmless Company, its officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to user's use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

  • Either party may terminate this agreement at any time. Users may terminate by discontinuing use and canceling subscriptions. We may terminate user access for Terms violations or at our discretion with reasonable notice.
  • Upon termination, user access ceases immediately. Users remain responsible for all charges incurred before termination. Data deletion follows our Privacy Policy retention and deletion procedures.
  • Provisions regarding intellectual property, liability limitations, indemnification, and dispute resolution survive termination.
  • We reserve the right to terminate user access for Terms violations or at our discretion with reasonable notice.
  • We reserve the right to discontinue the application and all related services at any time, with or without prior notice.

14. Governing Law and Dispute Resolution

  • These Terms are governed by Brazilian law, specifically the Brazilian Civil Code, Consumer Defense Code, and applicable federal regulations regarding electronic commerce and data protection.
  • Brazilian courts have exclusive jurisdiction over disputes involving Brazilian residents. For international users, disputes shall be resolved through binding arbitration under the rules of the Brazilian Arbitration Chamber, with proceedings conducted in English or Portuguese.
  • Brazilian consumers retain all rights under the Consumer Defense Code, including the right to seek resolution through consumer protection agencies (PROCON) and specialized consumer courts.
  • Before formal legal proceedings, parties agree to attempt good faith negotiation and, if necessary, mediation through recognized Brazilian commercial mediation services.

15. Additional Provisions

  • These Terms, together with our Privacy Policy, constitute the entire agreement between users and Company regarding Service use.
  • If any provision is found unenforceable, remaining provisions remain in full force and effect.
  • The Portuguese version of these Terms shall control in case of conflicts with translations.
